Terms of Service: Hosting Clients

1. Account Setup & Activation

Your account will be activated once payment is confirmed and the order has passed our fraud screening process.

  • Contact Requirement: It is your responsibility to provide a primary contact email address that is not hosted on the domain(s) you are registering.

2. Acceptable Use & Content

All services provided by Artopa, LLC must be used for lawful purposes only. Prohibited content includes, but is not limited to:

  • Copyrighted or trademarked material without authorization.
  • Material deemed threatening, obscene, or pornographic.
  • Unacceptable Examples: IRC Bots, Warez sites, pirated software, hate speech, and hacking programs/archives.
  • Liability: The customer agrees to indemnify Artopa, LLC from any legal claims resulting from the use of our services.

3. Zero Tolerance Spam Policy

We maintain a zero-tolerance policy toward unsolicited email, bulk emailing, and spam.

  • Termination: Any account found sending spam will be terminated immediately without notice.
  • Compliance: Artopa, LLC reserves the right to disable or modify any website, database, or account that violates this policy.
  • Cleanup Fees: We reserve the right to charge the account holder a cleanup fee for any costs incurred due to spam activity, at our sole discretion.

4. Payment & Billing

  • Advance Payment: Services must be paid for in advance of the service period.
  • Recurring Billing: All services will be billed on a recurring basis until a formal cancellation notice is provided.
  • Rate Changes: Artopa, LLC reserves the right to adjust monthly fees and service charges at any time.

5. Data Integrity & Backups

Your use of this service is at your sole risk. Artopa, LLC is not responsible for files or data residing on your account.

  • User Responsibility: You are responsible for maintaining independent, off-site backups of all data stored on Artopa, LLC servers.

6. Cancellations & Refunds

  • Right to Terminate: Artopa, LLC reserves the right to cancel any account at any time.
  • 30-Day Guarantee: We offer an unconditional 30-day money-back guarantee for managed shared hosting only.
  • Exclusions: There are no refunds for dedicated servers.
  • Prorated Refunds: Approved refund requests for unused service time will be issued on a prorated basis.

7. Resource Usage Constraints

To ensure server stability, users may not:

  • Exceed 25% of system resources for longer than 90 seconds (including CGI, FTP, PHP, and HTTP scripts).
  • Run interactive, real-time chat applications that utilize server resources (off-site/remotely hosted chats are permitted).
  • Run stand-alone, unattended server-side processes (e.g., daemons or IRCD).
  • Host gaming servers (e.g., Counter-Strike, Battlefield, etc.).

8. Bandwidth Allocation

Each hosting package includes a specific monthly bandwidth allowance.

  • Overage Policy: If an account exceeds its allocation, Artopa, LLC reserves the right to suspend the account until the next billing cycle, require an upgrade, or charge an overage fee.
  • No Rollover: Unused bandwidth does not carry over to the following month.

9. Indemnification

The Customer agrees to defend and hold Artopa, LLC (including its agents, employees, and officers) harmless from any demands, liabilities, or claims—including legal fees—arising from:

  1. Injury to person or property caused by products sold through our servers.
  2. Infringement of third-party proprietary rights or copyrights.
  3. Defective products sold via Artopa, LLC servers.

10. Disclaimer of Warranties

Artopa, LLC is not responsible for any damages your business may suffer. We provide services on an “as-is” basis and disclaim all warranties, express or implied, including fitness for a particular purpose. This includes data loss resulting from service interruptions, delays, or non-deliveries.

11. Policy Modifications

Artopa, LLC reserves the right to revise these policies at any time without prior notice.
