Email Marketing & Anti-Spam Policy
1. Our Stance on Spam
Artopa maintains a zero-tolerance spam policy. We actively monitor large import lists and high-volume outgoing emails. Any customer found using Artopa’s Email Marketing Solution to send spam will face immediate account termination.
- Reporting Abuse: If you suspect a violation, please notify us at abuse@artopa.com. We do not investigate anonymous complaints; please include the original email and its full headers.
2. Defining Spam & Consent
- What is Spam? Spam is Unsolicited Commercial Email (UCE), also known as “junk mail.” To avoid this label, you must only send emails to individuals who have specifically requested to receive them.
- Informed Consent: The recipient must be clearly notified about how their email will be used and must provide consent prior to collection.
- Pre-existing Relationship: A recipient qualifies if they have made a purchase, requested information, responded to a survey, or had documented offline contact with you.
3. Mandatory Technical Requirements
To remain compliant with our service, every email sent through Artopa must include:
- Unsubscribe Link: A functional, mandatory link that automatically updates your lists. Attempting to remove or deactivate this link will result in immediate account termination.
- Contact Information: Valid physical or digital contact information for the sender.
- Verification (Double Opt-In): Our system automatically sends new subscribers a confirmation email to verify their interest.
- Timely Processing: You must process any manual unsubscribe requests received via “reply-to” within 10 days.
4. Expressly Prohibited Activities
The following actions are strictly forbidden:
- Purchased or Inherited Lists: Using mass-mailing lists bought from third parties. Artopa is strictly opt-in.
- False Headers: Using misleading information to hide the point of origin or the transmission path.
- Domain Spoofing: Using a third party’s domain name without explicit permission to mask the sender’s identity.
- Misleading Subject Lines: Using deceptive “click-bait” or false information in the subject line.
- Subject Pivot: Using a list gathered for one specific topic to send content regarding an unrelated topic.
5. Compliance Self-Audit
If you answer YES to any of the following, you are likely in violation of our policy and risk account suspension:
- Are you importing a purchased or third-party list of any kind?
- Are you sending to generic addresses (e.g.,
sales@,info@,webmaster@)? - Are you sending to distribution lists that forward to multiple recipients?
- Are you mailing anyone who has not explicitly agreed to join your specific list?
- Have you falsified any part of the email’s origin or transmission path?
- Does your subject line contain misleading information?
- Does your email lack a working unsubscribe link or valid contact info?
6. Legal Compliance
While federal agencies like the FTC track spam (CAN-SPAM Act), state statutes vary significantly. Artopa requires all clients to adhere to the strictest possible standards to ensure compliance across all jurisdictions.
